How our business operates

Our business operates in two different ways

1. For supply of FMCG products

(i)  The order from the customer is collected through the site.

(ii) The ordered product’s list is transferred to the delivery agent

(iii) The delivery agent will purchase the products from any retail shop of his choice.

(iv) If any of the ordered item/items is/are not available in the first retail shop, then the delivery agent will move onto the next retail shop for purchasing the remaining item/items ,if same scenario is repeated then he will move onto the third retail shop and so on.

(v) If, even after visiting 10 retail shops if the delivery agent is not able to procure all the items ordered by the customer then the delivery agent will contact the customer and inform the situation via user registered phone number

(vi) If the customers allows the delivery agent to deliver the remaining product/products then

the remaining item/items are delivered to the customer .And along with the product/products the delivery agent will also provide the customer with gst or non gst invoice (provided by the retail shop)

and after taking full payment (cost of the remaining  products mentioned in the invoice/invoices + full delivery charge mentioned during checkout)  from customer  an online invoice for delivery charge will also be sent to the customer’s registered email id

(vii) If the customer denies the delivery agent to deliver the order (via phone) without all the items present, then the order will be cancelled without any cancellation or other charges from either side

(viii) If the delivery agent is able to procure all item/items from any retail shop then the product/products will be delivered to the customer and along with the product/products the delivery agent will also provide the customer with gst or non gst invoice (provided by the retail shop)

and after taking full payment (cost of the products mentioned in the invoice/invoices + full delivery charge mentioned during checkout)  from customer  an online invoice for delivery charge will also be sent to the customer’s registered email id

2. For supply of Hotel foods

(i)  The order from the customer is collected through the site.

(ii) The ordered product’s list is transferred to the respective hotels

(iii) The hotel staff will pack the food item in a food grade packet/container.

(iv) The packed food will be delivered to the customer by the hotel delivery staff.

(v)  Along with the food item the hotel  delivery staff will also provide the customer with  gst or non gst invoice of food item/items  and invoice of delivery (if applicable)

At the time of customer/user registration or otherwise certain data are collected

Cloudfare

Data collection during adding review

Currently review plugin is used for collecting reviews from the customers

Only registered customer who have purchased the product/products may leave review/reviews

  2. We process your order and set status of the order as “Completed” (or other paid order status configured in the settings).
  3. After a certain delay (configured in the settings), the customer will receive an email with an invitation to leave a review.

Therefore the user must understand and go through the third part policy before engaging (the card swiping machine, upi payment service provider has their own privacy policy) with us and also the customer must make sure that the credit/debit card provided to delivery agent by you is not misused at the time payment (for example the customer must make sure that the delivery agent is not misusing or engaging in any unfair means like taking photograph of your credit/debit card or in any way taking record of your card details in any paper or otherwise ) If any non-traditional / suspicious attitude is found from the delivery agent then immediately the customer must take back the credit/debit card from him/her and contact the customer agent for necessary action. YOUR ACCOUNT

You may need your own jackbite account to use certain jackbite Services, and you may be required to be logged in to the account and have a valid payment method associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. jackbite does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18 but at least 13 years of age, you may use the jackbite services only with involvement of a parent or guardian. Jackbite reserves the right to refuse service, terminate accounts, terminate your rights to use jackbite Services, remove or edit content, or cancel orders in its sole discretion.

Account & Registration Obligations

All shoppers have to register and login for placing orders on the Site. You have to keep your account and registration details current and correct for communications related to your purchases from the site. By agreeing to the terms and conditions, the shopper agrees to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in “email” or by contacting the customer service. 

Order Cancellation by Site / Customer

You as a customer can cancel your order anytime up to the cut-off time of the slot for which you have placed an order by calling our customer service or by using cancel order button in view orders section in account page. In such a case we will refund any payments (if any) already made by you for the order. The order may be cancelled by jackbite if the ordered product is unavailable with us or if the delivery is impossible for any reason without any prior notice. If we suspect any fraudulent transaction/activity by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders/account on the site. We will maintain a negative list of all fraudulent transactions/activities and customers and would deny access to them or cancel any orders placed by them or delete the jackbite account

Return & Refunds

We have a “no questions asked return and refund policy” which entitles all our members to return the product at the time of delivery if due to some reason they are not satisfied with the quality or freshness of the product including at least thirty percent of the shelf life is not left at delivery time. We will take the returned product back with us and issue refund (if paid already) of the return products which will be credited to your account on the Site(if applicable) or to the same account from where we received that money. If it is credited back to your site account then this can be used to pay your subsequent shopping bills.

You Agree and Confirm

  1. That in the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by jackbite for re-delivery shall be claimed from you.
  2. That you will use the services provided by the Site, its affiliates, consultants and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Site.
  3. You will provide authentic and true information in all instances where such information is requested of you. Jackbite reserves the right to confirm and validate the information and other details provided by you at any point of time. If upon confirmation your details are found not to be true (wholly or partly), it has the right in its sole discretion to reject the registration and debar you from using the Services and / or other affiliated websites without prior intimation whatsoever.

  6. That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.

  8. We have made every effort to display the colours of our products that appear on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate.
  9. That in the event that a non-delivery occurs on account of a mistake by jackbite (any reason) any difficulty faced by user/customer won’t be the responsibility of jackbite and pertaining to this no penalty be provided to the customer/user/you.

Indemnity

You agree to defend, indemnify and hold harmless Jackbite, its employees, directors, officers, agents and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Jackbite or any third party including but not limited to breach of any warranties, representations or undertakings or in relation to the non-fulfilment of any of your obligations under this User Agreement or arising out of the your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this User Agreement.

Termination

This User Agreement is effective unless and until terminated by either you or Jackbite. You may terminate this User Agreement at any time, provided that you discontinue any further use of this Site. Jackbite  may terminate this User Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, Such termination will be without any liability to Jackbite. Upon any termination of the User Agreement by either you or Jackbite, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the User Agreement or otherwise. Jackbite ‘s right to any Comments shall survive any termination of this User Agreement. Any such termination of the User Agreement shall not cancel your obligation to pay for the product already ordered from the Website or affect any liability that may have arisen under the User Agreement.

DISPUTES

Any dispute or claim relating in any way to your use of any JACKBITE Service, or to any products (if applicable) or services (if applicable) or distributed (if applicable) by Jackbite or through Jackbite.com will be resolved by teleconversation or email (Between customer and jackbite associate), rather than in court, except that you may assert claims in small claims court if your claims qualify. The law in the state of Kerala will apply to this agreement.

User should only register for jackbite services only if they are willing to respect the above condition

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in (teleconversation or email (Between customer and jackbite associate)) we each waive any right to a jury trial.

APPLICABLE LAW

By using any Jackbite Service, you agree that the case be dealt with laws in the state Kerala and in Kerala(Thrissur dt), without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Jackbite.
